1. Agreement to these terms
These Terms of Use (“Terms”) form an agreement between you and Incep Digital (“FlowPrompt,” “we,” “us,” or “our”) governing your use of the FlowPrompt mobile application, website, and support materials. By downloading, purchasing, or using FlowPrompt, you agree to these Terms and our Privacy Policy. If you do not agree, do not use FlowPrompt.
You must be legally able to enter into this agreement. If you use FlowPrompt for an organization, you confirm that you have authority to accept these Terms for that organization.
2. License to use FlowPrompt
Subject to these Terms and the applicable app store rules, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use FlowPrompt on devices you own or control for your personal or internal business purposes.
You may not copy, sell, rent, sublicense, distribute, reverse engineer, bypass access controls, extract source code except where applicable law permits, or use FlowPrompt to build or benchmark a competing product without written permission.
3. Your scripts and content
You retain ownership of scripts and other content you create, import, or store in FlowPrompt. Because FlowPrompt stores scripts locally and does not operate a cloud-content service, you are responsible for maintaining device backups and exported copies that are appropriate for your needs.
You represent that you have the rights needed to use, record, perform, export, or share your content. Do not use FlowPrompt to create or present material that infringes intellectual property, violates privacy or publicity rights, is unlawful, or causes harm.
4. Free trial, subscriptions, and lifetime access
7-day free trial
FlowPrompt may offer a 7-day free trial of FlowPrompt Pro. Availability and eligibility can depend on your platform, store account, region, and prior trial history. The store checkout screen controls the exact trial terms, plan, price, renewal date, and currency shown to you before confirmation.
Subscriptions
If you begin a subscription that includes a trial, the subscription may automatically renew at the price and interval shown by Apple or Google unless you cancel through your store account before the deadline shown there. App deletion does not cancel a subscription. Apple or Google handles billing, cancellation, refunds, and payment disputes under its policies.
Lifetime purchase
Where offered, “lifetime” means access to the FlowPrompt Pro features included in the purchased product for as long as we continue to make that version or successor access available on the supported platform. It does not guarantee that every future product, separate service, operating system, or device will be supported forever.
Changes
We may change future prices, plan availability, or included features. Store rules govern notice and consent for changes to an existing subscription. Features already unlocked by a completed lifetime purchase will not be removed merely to require a subscription, except where needed for security, law, platform requirements, service retirement, or circumstances outside our reasonable control.
5. Acceptable use
You agree not to:
- Use FlowPrompt in violation of law or another person’s rights
- Interfere with the app, purchase validation, security, or normal operation
- Use automated methods to probe, overload, or exploit FlowPrompt or its providers
- Misrepresent your relationship with FlowPrompt or Incep Digital
- Remove copyright, trademark, or proprietary notices
6. Third-party services and app stores
FlowPrompt relies on platform and third-party services for distribution, purchases, speech recognition, and optional attribution. Your use of those services is also governed by their terms. Apple and Google are not responsible for support beyond obligations imposed by their standard store terms or applicable law.
7. Updates, availability, and termination
We may release updates, fix defects, change features, or discontinue support for older operating systems or devices. We do not promise that FlowPrompt will always be available, compatible with every camera app, or uninterrupted. Overlay and Picture-in-Picture behavior can depend on Android or iOS, device settings, manufacturer restrictions, and permissions.
You may stop using FlowPrompt at any time. We may suspend or terminate the license if you materially breach these Terms. Sections that by their nature should survive termination—including ownership, disclaimers, limits of liability, and dispute provisions—will survive.
8. Disclaimers
To the maximum extent permitted by law, FlowPrompt is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee a particular recording, presentation, speaking, commercial, or audience outcome.
FlowPrompt is not designed for emergency communications, medical use, safety-critical operations, or situations where a display or scrolling failure could cause injury or material damage.
9. Limitation of liability
To the maximum extent permitted by law, Incep Digital and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost content, lost recordings, business interruption, or loss of goodwill arising from FlowPrompt.
Our total liability for claims relating to FlowPrompt will not exceed the greater of the amount you paid for FlowPrompt during the 12 months before the event giving rise to the claim or US $25. These limits do not apply where prohibited by law, and nothing in these Terms limits rights that cannot legally be waived.
10. Governing terms and disputes
These Terms are governed by the laws applicable at Incep Digital’s principal place of business, without regard to conflict-of-law principles, except that mandatory consumer-protection rules in your place of residence continue to apply. Before filing a formal claim, please contact us and allow 30 days for an informal resolution where permitted.
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. These Terms and the Privacy Policy are the complete agreement about FlowPrompt unless a separate written agreement applies.
11. Changes to these terms
We may update these Terms to reflect product, legal, or operational changes. The revised date will appear above. If a change materially affects existing users, we will provide reasonable notice where required.
